COMMISSION AGENDA MEMORANDUM Item No. 8c ACTION ITEM Date of Meeting March 27, 2018 DATE: March 19, 2018 TO: Port of Seattle Commission FROM: Aaron Pritchard, Commission Policy Manager SUBJECT: Resolution to Amend Resolution 3725 and 3736 ACTION REQUESTED Request introduction of Resolution No. 3746: A resolution of the Port of Seattle Commission amending Resolution 3725 to change the threshold for applying Project Labor Agreements to Port projects and to add a small business threshold for applying prevailing wage; and amending Resolution 3736 to amend the definitions that include a threshold for applying Project Labor Agreements to Port projects. EXECUTIVE SUMMARY The amendments contained in Resolution 3746 change the threshold for applying Project Labor Agreements in the Port's Construction Labor Policy and in the Port's Priority Hire policy.The Resolution also adds a small business threshold for applying prevailing wage on projects on Port of Seattle leased property that involve no Port funding. JUSTIFICATION The Port of Seattle Commission approved Resolution 3725 on October 25, 2016. The resolution was drafted by the Commission's Projects and Procurement Committee, chaired by Commissioners Albro and Creighton, along with external advisors from labor, small businesses, general contractors, and minority advocacy groups. The primary change proposed in these amendments will adjust the threshold for an assumption in favor of a Project Labor Agreement from $5 million in labor costs to a $5 million contract. The rationale for the change is that the City of Seattle and King County both have or will have a $5 million contract level creating further regional alignment. The City, County and Port have been working closely on engagement for increasing the labor pool available for our large projects through priority hire. The more the Port and regional partners can use similar terms and approaches to projects in the region the easier it is to accomplish our priority hire and Project Labor Agreement objectives. This also provides more clarity for the Port and Labor when the Port evaluates the applicability of a Project Labor Agreement to a project. Template revised September 22, 2016.
