RESOLUTION NO. 3724 

A RESOLUTION of the Port Commission of the Port of Seattle declaring certain real
property located in the City of Auburn surplus and no longer needed
for port district purposes and authorizing its sale to King County. 

WHEREAS, the voters of King County, pursuant to the provisions of enabling
legislation adopted by the Legislature of the State of Washington, Chapter 92, Laws of 1911,
RCW 53.04.010, authorized and approved at a special election held in King County on the 5th
day of September 1911, the formation of a port district coextensive with King County to be
known as the Port of Seattle; and 

WHEREAS, the Port of Seattle was thereupon established as a port district and has since
been and now is a duly authorized and acting port district of the State of Washington and
operator of Seattle-Tacoma International Airport ("Airport"); and 
WHEREAS, the Port owns the real property described on attached Exhibit A (the
"Property"); and 

WHEREAS, the Property was included in the approximately 87 acres acquired by the
Port for Third Runway mitigation, of which approximately 60 acres were ultimately included in
the Third Runway mitigation project and subject to restrictive covenants that preclude
development; and 

WHEREAS, the Property consists of approximately 1.62 acres adjacent to the Green
River, is in the flood plain, land locked and subject to Green River course changes. 

WHEREAS, the Property is not included in Unit 18 of the Port of Seattle
Comprehensive Scheme of Harbor Development; and 

WHEREAS, King County desires to acquire the Property to extend its Green River Trail
System.

WHEREAS, the members of the Port of Seattle Commission have discussed and
considered the proposed property transfer in light of all comments by members of the public; 

NOW, THEREFORE, BE IT RESOLVED by the Port Commission of the Port of
Seattle as follows: 

Section 1. The real property legally described ______________________ is hereby
declared surplus to Port of Seattle needs and no longer needed for Port purposes: 

Section 2. Port staff is authorized to take all necessary steps to arrange for the sale
of said real property and improvements, and to execute all documents necessary to accomplish
its sale to King County in accordance with state law. The real property described on Exhibit A 
attached hereto, has an appraised value of $1,000.00 with a highest and best use as wetland
buffer. 

ADOPTED by the Port Commission of the Port of Seattle at a duly noticed meeting held

session by the signatures of the Commissioners voting in favor thereof and the seal of the
Commission.

EXHIBIT A 
LEGAL DESCRIPTION 

That portion of the George E. King Donation Land Claim No. 40, in the southeast quarter of the
northeast quarter, Section 31, Township 22 North, Range 5 East, W.M., in King County,
Washington, described as follows: 
Commencing at a 6" X 6" sandstone monument marking the southwest corner of the R.H. Beatty
Donation Land Claims Numbers 37 and 44; 
Thence south 89"00'01" east along the south line of said R.H. Beatty Donation Land Claim and
the north line of the W.A. Cox Donation Land Claim Number 38, a distance of 2,643.18 feet to a
2" diameter concrete filled iron pipe marking the southeast corner of said R.H. Beatty Donation
Land Claim and the northeast corner of said W.A. Cox Donation Land Claim;
Thence continuing south 8900'01" east 2,255.93 feet to a point on a line established by
boundary line agreement recorded under recording number 8110150749; 
Thence along said line, the following courses: 
south 4626'33" east, 103.72 feet; 
south 3419'49" east, 211.01 feet; 
south 0948'39" west, 412.45 feet; 
south 0143'38" east, 263.60 feet; 
south 0838'47" west, 208.18 feet to southeast corner of Tract "P" as shown on the Plat for Trail
Run  Division 3, filed for record December 18, 2009 in Volume 254 of Maps, pages 9 through
14, and recorded under recording number 20091218001114, said corner also being the point of
beginning; 
Thence continuing along the line established by said boundary line adjustment, the following
courses; 
south 2317'33" west, 479.64 feet; 
south 0433'51" east, 300.00 feet; 
Thence leaving said line, north 1725'38" west, 313.44 feet; 
Thence north 0738'50" east, 448.66 feet to the south line of said Tract P; 
Thence south 8849'05" east and along said south line , 200 feet to the point of beginning.
