RESOLUTION NO. 3718


A RESOLUTION of the Port Commission of the Port of Seattle amending Unit 18
(Seattle-Tacoma International Airport) of the Comprehensive
Scheme of Harbor Improvements of the Port of Seattle, declaring
certain real property located in the City of Burien surplus and no
longer needed for port district purposes; authorizing its sale to
Bridge Burien LLC and deleting said property from Unit 18 of the
'
Comprehensive Scheme.

WHEREAS, the voters of King County, pursuant to the provisions of enabling
legislation adopted by the Legislature of the State of Washington, Chapter 92, Laws of 1911,
authorized and approved at a special election held in King County on the 5th day of September

1911, the formation of a port district coextensive with King County to be known as the Port of
Seattle, and the Port of Seattle was thereupon established as a port district; and

WHEREAS, Unit 18 of the Comprehensive Scheme of Harbor Improvements
("Comprehensive Scheme") was initially created by Port Commission adoption of Resolution
No. 1194 on September 16, 1946; and

WHEREAS, an ofcial public hearing was held March 8, 2016, after notice of such
hearing was duly published as provided by law, on the question of whether said Unit 18 should
be amended and modied to provide for certain portion thereof to be declared surplus to Port of

Seattle needs and deleted from Unit 18; and

WHEREAS, the Port of Seattle Commission has heard from all persons desiring to speak
at said public hearing withregard to the proposed amendment and modication to Unit 18; and

WHEREAS, the Port acquired the property in question (commonly known as 854 South
146th Street, in the City of Burien) in 2006 as part of the Airport's Federal Aviation

Administration approved noise mitigation program; and

WHEREAS, the property is contiguous to a large parcel that the City of Burien is

proposing to sell to Bridge Burien LLC for the development of an airport compatible industrial

use; and

WHEREAS, the proposed project in the City of Burien is expected to create

approximately 250 jobs; and

WHEREAS, the maps and other data regarding the property proposed for conveyance to

Bridge Burien LLC are on le at the Port ofces; and

WHEREAS, the Port of Seattle Commission has heard from all persons desiring to speak

at said public hearing with regard to the proposed property transfer; and

WHEREAS, the members of the Port of Seattle Commission have discussed and

considered the proposed property transfer in light of all comments by members of the public at

the public hearing;

NOW, THEREFORE, BE IT RESOLVED by the Port Commission of the Port of
Seattle as follows:

Section 1. The real property (commonly known as 854 South 146th Street, in the City of
Burien) legally described below and which is part of Unit 18 of the Comprehensive Scheme is
hereby declared surplus to Port of Seattle needs, is no longer needed for Port purposes and is
deleted from Unit 18 of the Comprehensive Scheme:

THE NORTH 120.00 FEET OF THE SOUTH 135.00 FEET OF THE WEST 74.93
FEET OF THE EAST 104.93 FEET OF THE EAST HALF OF THE
NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF THE
NORTHEAST QUARTED OF SECTION 20, TOWNSHIP 23 NORTH, RANGE 4
EAST, WILLAMETTE MERIDIAN, IN KING COUNTY, WASHINGTON;

TOGETHER WITH AN EASEMENT FOR ROADWAY PURPOSES OVER THE
NORTH 120.00 FEET OF THE SOUTH 135.00 FEET OF THE EAST 30.00
FEET OF THE EAST HALF OF THE NORTHWEST QUARTER OF THE
NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SAID
SECTION 20;

EXCEPT THAT PORTION LYING WITHIN SOUTH 146TH STREET

Section 2. Port staff is authorized to take all necessary steps to arrange for the sale Of said

real property and improvements, and to execute all documents necessary to accomplish its sale to
Bridge Burien LLC in accordance with state law. The real property described above has an
appraised value of$117,000.00.
