RESOLUTION NO. 3701 
A RESOLUTION of the Port Commission of the Port of Seattle repealing Resolution
No. 3549, as amended, relating to extension of the Port's nondiscrimination
policy for provision by contractors of domestic
partner benefits. 

WHEREAS, the Port of Seattle Commission adopted Resolution No. 3549, as amended on
October 25, 2005,  establishing  a  policy  to extend the Port's non-discrimination policy to Port
contractors for the provision of domestic partner benefits; and 
WHEREAS, repealing Resolution No. 3549, as amended, is consistent with current state law
and facilitates administration, improves efficiency, and clarifies Port requirements to contractors
doing business with the Port; and 
WHEREAS, in November 2012 Washington state voters approved Referendum 74
approving same-sex marriage; and 
WHEREAS, RCW 26.04.010 was amended in 2012 to state: "Marriage is a civil contract
between two persons who have each attained the age of eighteen years, and who are otherwise
capable."; and 
WHEREAS, Resolution 3549, as amended, is redundant and unnecessary in light of RCW
26.04.010; 
NOW THEREFORE, BE IT RESOLVED by the Port Commission of the Port of Seattle 
that Resolution No. 3549, as amended, is repealed; and 
BE IT FURTHER RESOLVED that the repeal of Resolution 3549, as amended shall not
prohibit the Port from implementing any policies and procedures regarding non-discrimination or
equal opportunity where the law requires or allows; 
ADOPTED by the Port Commission of the Port of Seattle this ___________ day of

Commissioners voting in favor thereof and the seal of the Commission duly affixed.
