Item No. 6a_Attach_1 Date of Meeting April 10, 2012 RESOLUTION NO. 3661 A RESOLUTION of the Port Commission of the Port of Seattle declaring certain personal property surplus and no longer needed for Port purposes, authorizing its transfer to the Burke Museum of Natural History and Culture, and authorizing the Chief Executive Officer to execute all documents related to such transfer. WHEREAS, the voters of King County, pursuant to the provisions of enabling legislation adopted by the Legislature of the State of Washington, Chapter 92, Laws of 1911, RCW 53.04.010, authorized and approved at a special election held in King County on the 5th day of September 1911, the formation of a port district coextensive with King County to be known as the Port of Seattle; and WHEREAS, the Port of Seattle was thereupon established as a port district and has since been and now is a duly authorized and acting port district of the State of Washington; and WHEREAS, the Port has accumulated various archaeological artifacts and specimens during decades of improving and maintaining its real properties; and WHEREAS, the Port has the responsibility under federal law to preserve for future use these archaeological artifacts, specimens, and records, listed in Attachment A to Exhibit A and defined below ("Collection") and has contracted with the Burke Museum since 2004 for curatorial services for the Collection; and WHEREAS, the Port desires to convey title and permanent custody of the Collection to the Burke Museum; and WHEREAS, the Burke Museum desires to obtain title to and permanent custody of the Collection from the Port; and WHEREAS, the Burke Museum meets the standards specified in 36 CFR, Part 79 (Curation of Federally-Owned and Administered Archaeological Collections); and WHEREAS, the Parties recognize the benefits to the public by having title to and permanent custody of the Collection transferred to the Burke Museum; and WHEREAS, the Port of Seattle Commission has heard from all persons desiring to speak at the public hearing regarding the proposed property transfer; and WHEREAS, the Port of Seattle Commission has considered the proposed property transfer and any comments by members of the public attending the public hearing; NOW, THEREFORE, BE IT RESOLVED by the Port Commission of the Port of Seattle as follows: Section 1. The Collection, described in Attachment A to the Interlocal Agreement that is attached to this Resolution as Exhibit A, is no longer needed for Port purposes and is declared surplus to Port needs. Section 2. The Chief Executive Officer is authorized to take all steps and execute all documents necessary to convey title and transfer permanent custody of the Collection to the Burke Museum of Natural History and Culture for the sum of $117,045, including execution of the Interlocal Agreement ("Agreement") to Convey Title and Permanent Custody of the Artifacts Between the Burke Museum of Natural History and Culture and the Port of Seattle that is attached to this Resolution as Exhibit A. ADOPTED by the Port Commission of the Port of Seattle at a regular meeting thereof, held this ____ day of ____________, 2012, and duly authenticated in open session by the signatures of the Commissioners voting in favor thereof and the seal of the Commission Port Commission
