Per our conversation, we would like to clarify the interpretation. Based on the code provisions governing Land Use Code interpretations (SMC 23.88.020), interpretations are site specific. DPD's interpretation is based on the specific facts relating to the permit history for Terminal 5, and facts relating to the presence of a drilling rig and related vessels proposed at that site.
