RESOLUTION NO. 3708 

A RESOLUTION   of the Port Commission of the Port of Seattle, (i)
amending Unit 20 of the Comprehensive Scheme of
Harbor Improvements of the Port of Seattle by
declaring certain real property surplus and no longer
needed for Port of Seattle district purposes, deleting
it from the Comprehensive Scheme, and authorizing
the Chief Executive Officer to execute all documents
necessary to transfer title of the property to the State
of Washington Department of Transportation; and
(ii) further amending Unit 20 of the Comprehensive
Scheme to add certain real property conveyed to the
Port by the State of Washington Department of
Transportation. 

WHEREAS, the voters of King County, pursuant to the provisions of enabling
legislation adopted by the Legislature of the State of Washington, Chapter 92, Laws of 1911,
RCW 53.04.010, authorized and approved at a special election held in King County on the 5th
day of September 1911, the formation of a port district coextensive with King County to be
known as the Port of Seattle ("Port"); and 
WHEREAS, the Port was thereupon established as a port district and has since been and
now is a duly authorized and acting port district of the State of Washington; and 
WHEREAS, the original Comprehensive Scheme of Harbor Improvements of the Port of
Seattle ("Comprehensive Scheme") was fixed in Resolution No. 17 of the Port Commission and
was ratified by the qualified electors of the Port district at a special election held therein on
March 5, 1912; and 
WHEREAS, Port owned real property consisting of a portion of Terminal 46 located in
Unit 20 of the Comprehensive Scheme consisting of approximately 4862 square feet of land

("Land") described in attached Exhibit A, and 2611 square feet of airspace corridor ("Airspace") 
described in attached Exhibit B,  (the Land and Airspace referred to, collectively, as the
"Property") is needed by the State of Washington Department of Transportation ("WSDOT") for
use in Stage III of the SR99, South Holgate Street to South King Street Viaduct Replacement
Project ("Project"); a Project critical to public safety because the viaduct is at risk of failure from
earthquakes; and 
WHEREAS, WSDOT is acquiring the Property under threat of condemnation; and 
WHEREAS, on July 30, 2012, the Port and WSDOT entered into a Possession and Use
Agreement granting WSDOT possession and use rights to the Property in exchange for
WSDOT's payment of just compensation ("Just Compensation") to the Port; and 
WHEREAS, subsequently the Port requested roadway bridge widening design and
construction changes to the Project in exchange for a reduction in the Just Compensation, and the
Port's agreement to (i) accept a tract of State-owned surplus land located in King County, WA,
identified in the State's records as Inventory Control No. 7-17-09828 and described in attached
Exhibit C ("Surplus Land") as consideration for the Property; and (ii) transfer to WSDOT 1768
of the 4862 square feet of Land and 2524 of the 2611 square feet of Airspace as consideration for
the Port's request to change certain roadway bridge widening design and construction aspects of
the Project; and 
WHEREAS, the maps and other data regarding the Property are on file at the Port's
offices; and

WHEREAS, an official public hearing was held on April 28, 2015, after notice of such
hearing was duly published as provided by law, on the question as to whether said Unit 20
should be amended and modified to declare the Property surplus to Port needs and deleted from
the Comprehensive Scheme; and 
WHEREAS, at said public hearing the Port Commission heard from all persons desiring
to speak upon such matters, and considered other data pertaining to the Property; and 
WHEREAS, the members of the Port Commission have discussed and considered the
proposed property transfer in light of all comments by members of the public at the public
hearing; and 
NOW, THEREFORE, BE IT RESOLVED by the Port Commission of the Port of
Seattle as follows: 

Section 1. The Property described on attached Exhibit A and Exhibit B, and part of
Unit 20 of the Comprehensive Scheme is hereby declared surplus to Port of Seattle needs and no
longer needed for Port purposes. Said Property is hereby deleted from Unit 20 of the Port of
Seattle Comprehensive Scheme. 

Section 2. The Chief Executive Officer is authorized to take all steps and execute all
documents necessary to (i) transfer title of the Property to the State of Washington Department
of Transportation and (ii) accept transfer of the Surplus Land to the Port. 

Section 3. Unit 20 of the Port of Seattle Comprehensive Scheme is hereby amended to
include the Surplus Land described on attached Exhibit C.
