PORT OF SEATTLE MEMORANDUM COMMISSION AGENDA Item No. 6a ACTION ITEM Date of Meeting December 22, 2015 DATE: December 18, 2015 TO: Ted Fick, Chief Executive Officer FROM: Mark Reis, Managing Director, Aviation Division Linda Stewart, Director, Aviation Community Partnerships SUBJECT: Amendment 4 to the 2005 Port/City of SeaTac Interlocal Agreement (ILA-2) ACTION REQUESTED Request Commission authorization for the Chief Executive Officer to execute Amendment 4 to the 2005 Port/City of SeaTac Interlocal Agreement (ILA-2), to extend the term of the agreement for two more years from February 16, 2016, through February 16, 2018. SYNOPSIS The current term of ILA-2 is scheduled to end on February 16, 2016. The main objective of Amendment 4 to ILA-2 is to extend the term of the agreement for two more years to February 16, 2018. This extension will allow for airport operational land use needs to be clarified in the Sustainable Airport Master Plan before the Port and the City of SeaTac consider a more extensive revision of the agreement. The City of SeaTac reviewed Amendment 4 to ILA-2 during a special study session on December 17, 2015, and is scheduled to approve proposed Amendment 4 to ILA-2 during a council meeting on December 22, 2015. BACKGROUND On February 16, 2006, the Port and the City entered into an Interlocal Agreement (ILA-2) that replaced the previous ILA (ILA-1) signed in 1997. The purpose of ILA-2 is to jointly establish a mutual and cooperative system for the Port and the City to exercise a variety of jurisdictional authorities to avoid disputes or potential claims and to obtain fair and equitable resolution of any potential disputes or claims. ILA-2 is scheduled to expire on February 16, 2016. The Port and City agree that extending the term of ILA-2 for two more years will allow them to consider revisions to ILA-2 after completion of the Sustainable Airport Master Plan (SAMP). Waiting until after completion of SAMP allow the parties to consider revisions to ILA-2 in a more fully informed manner about future airport operational needs. Template revised May 30, 2013. COMMISSION AGENDA Ted Fick, Chief Executive Officer December 18, 2015 Page 2 of 2 In addition to extending the term of ILA-2 to February 16, 2018, Amendment 4 will amend Exhibit C of ILA-2 and will repeal Exhibit D of ILA-2 as summarized below: EXHIBIT C, INTERAGENCY COOPERATION & DEVELOPMENT COMMITMENTS Eliminates the City's responsibility to set aside 22% of parking tax revenues for the proposed South Access project to the airport after February 16, 2016. Establishes agreement that the City will reconcile the amount of parking tax remaining after February 16, 2016, and will notify the Port by July 1, 2016 as to the remaining amount of parking tax revenues. It is anticipated that the total remaining parking tax funds available after February 16, 2016 will be approximately $3.0 million. The Port and City agree these remaining parking tax funds will be spent on a transportation project or projects that will mitigate impacts on City traffic and/or provides airport access. The Port and City will work together to identify an appropriate project(s) for the expenditure of these remaining parking tax funds. EXHIBIT D, MATERIAL HAULING PROVISIONS FOR PORT HAUL PROJECT Repeals special material haul requirements. Establishes agreement that the Port will comply with current City Code requirements for material haul routes and permitting after February 16, 2016.
