PORT OF SEATTLE MEMORANDUM COMMISSION AGENDA Item No. 5b Date of Meeting December 7, 2010 DATE: November 15, 2010 TO: Tay Yoshitani, Chief Executive Officer FROM: Stan Shepherd, Manager, Airport Noise Programs Kim Albert, Senior Manger ICT Business Services SUBJECT: Contract for Airport Noise Monitoring System Maintenance FIVE YEAR AMOUNT: $1,100,000 SOURCE OF FUNDS: ICT Expense Budget, 100% Airport Development Fund SALES TAX: $95,000 ACTION REQUESTED: Authorization for the Chief Executive Officer to execute appropriate contract documents to continue receiving software and hardware maintenance services for the Noise Programs flight tracking and noise monitoring system for annual payments of $189,000 plus inflation and sales tax for up to five (5) years for total payments of $1,100,000. SYNOPSIS: Bruel and Kjaer (B&K) is the current and proprietary provider of flight tracking and noise monitoring services to the Port of Seattle. B&K recently acquired the Lochard Corporation which originally provided the Port's flight tracking and noise monitoring system. We are requesting authorization for a replacement maintenance contract that is an extension and update to our existing Lochard maintenance contract that is soon to expire. On November 18, 2010, the Port of Seattle approved an exemption from competition, waiver # 2010 047, and notified the Commission of this waiver, for this replacement contract. BACKGROUND: Through a competitive bid process in 1999, the Port of Seattle chose the Lochard Corporation to install and maintain a state-of-the-art flight tracking and noise monitoring system at Seattle-Tacoma International Airport. This system replaced a very old flight tracking program and upgraded the noise monitoring system from 11 monitors to 25. Currently this flight tracking and noise monitoring system is the fundamental equipment needed to monitor and maintain data for both aircraft operations and associated noise COMMISSION AGENDA Tay Yoshitani, Chief Executive Officer November 15, 2010 Page 2 of 2 statistics. The hardware and software has been updated and expanded in the years since 1999; the replacement contract reflects this. The current Part 150 Update will once again evaluate the Port's noise monitoring and flight tracking system to make sure that it meets the needs of the noise programs and current industry technology. If the Part 150 study suggests an upgrade to this system, then any acquisition of hardware and software could become 80% Federal Aviation Administration (FAA) grant eligible provided it is approved by the FAA. If appropriate, the Port will procure a new system through a competitive process after the Part 150 Update is complete. This replacement B&K contract is for five (5) years with the Port option to cancel at any time with 90 days written notice. Since this system is proprietary, there are no o ther vendors that can provide the support needed to maintain this critical system. On November 18, 2010, the Port of Seattle approved an exemption from competition, waiver # 2010 047, and notified the Commission of this waiver. SOURCE OF FUNDS: Contract payments for 2010 are already included in the ICT expense budget. The costs are directly charged to Aviation so the funding source is the Airport Development Fund. Payments for future years will be included in future ICT annual expense budgets. PREVIOUS COMMISSION ACTION: There has been no previous Commission action related to this maintenance contract.
