PORT OF SEATTLE MEMORANDUM COMMISSION AGENDA Item No. 6b ACTION ITEM Date of Meeting December 2, 2014 DATE: November 25, 2014 TO: Ted Fick, Chief Executive Officer FROM: Ralph Graves, Managing Director, Capital Development Anne Purcell, Sr. Port Counsel SUBJECT: Resolution 3701 Repealing Resolution No. 3549, as amended ACTION REQUESTED Request First Reading of Resolution No. 3701, repealing Resolution No. 3549, as amended: A Resolution of the Port Commission of the Port of Seattle extending the Port's non-discrimination policy to Port contractors for the provision of domestic partner benefits. SYNOPSIS In November 2012, Washington state voters approved Referendum 74 approving same-sex marriage. In that same year, the legislature amended state law to legalize same-sex marriage. As a result, Resolution 3549, as amended, has become redundant and unnecessary. BACKGROUND In 1994, the Port adopted a policy to extend the same employee benefits to domestic partners as are available to employee spouses and to extend non-discrimination principles to apply to sexual orientation. The Port-sponsored benefit plans were updated to provide domestic partner coverage. Resolution 3549, as amended, was introduced at the October 11, 2005, Commission meeting extending equal benefit requirements to Port contractors for the provision of domestic partner benefits. Repealing Resolution 3549, as amended, is consistent with current state law and facilitates administration, improves efficiency, and clarifies Port requirements to contractors doing business with the Port. Repealing Resolution No. 3549, as amended, will have no effect on the Port's domestic partnership policy that has been in place since 1994.
