Item No.: 6c_supp_a Meeting Date: December 2, 2014 RESOLUTION NO. 3702 A RESOLUTION of the Port Commission of the Port of Seattle declaring the sewer mains and manhole located within the public right of way on S 170th St, SeaTac, WA to be surplus and no longer needed for Port District purposes and authorizing the Chief Executive Officer to execute all documents necessary for transfer of the title of these sewer mains and manhole to the Valley View Sewer District. WHEREAS, the Doug Fox Site Improvements project required the extension of the Valley View Sewer District sewer main; and WHEREAS, on July 9, 2013, the Port of Seattle Commission authorized the Chief Executive Officer to enter into a Developer Extension Agreement with the Valley View Sewer District regarding the provision of sewer service to the Doug Fox Lot located at 2626 S 170th St, SeaTac, WA; and WHEREAS, the Doug Fox Site Improvements project has completed the sewer main improvements within the public right of way on S 170th St, SeaTac, WA, described in Section 1 below and depicted on attached Exhibit A; and WHEREAS, pursuant to the terms of the Developer Extension Agreement title to the sewer main and improvements is to be transferred to the Valley View Sewer District upon completion; and WHEREAS, Chapter 39.33 of the Revised Code of Washington provides that the Port may "sell, transfer, exchange, lease or otherwise dispose of any propertyto the state or any municipality or any political subdivision thereofon such terms and conditions as may be mutually agreed upon"; and WHEREAS, said sewer improvements are no longer needed by the Port and may be declared surplus; and NOW, THEREFORE, BE IT RESOLVED by the Port Commission of the Port of Seattle that: Section 1. The sewer improvements consisting of 138 feet of 8 inch sewer main and a sewer manhole located within the public right of way on S. 170th Street, SeaTac, WA, depicted on attached Exhibit A are no longer needed for Port purposes and are declared surplus. Section 2. Pursuant to Chap. 39.33 RCW, the Chief Executive Officer is authorized to take all steps and execute all documents necessary to transfer title to the sewer mains and manhole to the Valley View Sewer District. The fair market value of the sewer mains and manhole is $82,211. ADOPTED by the Port Commission of the Port of Seattle at a regular meeting thereof, held this _____day of _______________, 201__, and duly authenticated in open session by the signatures of the Commissioners voting in favor thereof and the seal of the Commission.
